DEA Reschedules Cannabis to Schedule 3
The DEA has officially confirmed that after a recommendation from an August 2023, that Cannabis will now be rescheduled to Schedule 3, from its current status in Schedule 1. This will be the first major change in the DEA in over 50 years.
Cannabis will now be considered to be in the same category as testosterone, anabolic steroids, and ketamine.
What this means is anyone’s guess. Rescheduling may allow Cannabis Businesses to begin taking federal tax deductions, which they are currently unable to do, due to 280E. Some critics say that this would also mean that dispensaries and cannabis businesses would now need to register with the DEA, as well as strict requirements on the movement and sale of cannabis, making them more akin to pharmacies.
Though not active yet, it was announced that there will be a 90 Day Comment period, before the Rescheduling occurs. If you’d like to comment on the rescheduling, or comment that the DEA should completely deschedule cannabis.
